These terms and conditions (the "Terms and Conditions") govern the use of adventureswithmeaning.com (the "Site"). This Site is owned and operated by AWM Private Guided Tours Ltd. 

This Site relates to guided outdoor experiences and adventure tourism services.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Limitation of Liability

AWM Private Guided Tours Ltd and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless AWM Private Guided Tours Ltd and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

 

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and AWM Private Guided Tours Ltd are unable to resolve any dispute through informal discussion, then you and AWM Private Guided Tours Ltd agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Adventures With Meaning Inc. The costs of any mediation or arbitration will be shared equally between you and Adventures With Meaning Inc.

Notwithstanding any other provision in these Terms and Conditions, you and AWM Private Guided Tours Ltd agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Additional Terms

1. Assumption of Risk (Outdoor Activities)

Guests acknowledge and understand that participation in guided outdoor activities with AWM Private Guided Tours Ltd. involves inherent risks that cannot be eliminated, even with careful planning, professional guidance, and conservative decision-making.

  • These risks may include, but are not limited to:
    hiking and snowshoe travel on uneven, natural terrain, variable and rapidly changing weather conditions, exposure to wildlife and natural hazards, changing trail surfaces such as mud, snow, ice, rocks, roots, and water crossings,
    physical exertion, slips, trips, or falls associated with outdoor travel.

    Guests acknowledge that mountain environments are dynamic by nature and that conditions may change before or during a journey. While AWM Private Guided Tours Ltd. takes reasonable steps to manage risk through route selection, pacing, instruction, and professional judgment, guests understand that not all risks can be foreseen or controlled.
    Participation in any journey is subject to the execution of a season-specific waiver of liability, which is provided separately and drafted by legal counsel. Waivers may differ by season or activity (for example, hiking or snowshoe travel) and form an integral part of the agreement between the guest and AWM Private Guided Tours Ltd.

    By participating in a journey, guests confirm that they have reviewed, understood, and agreed to the applicable waiver in addition to these Terms & Conditions.
    Guests further acknowledge that assumption of risk is an essential component of outdoor experiences and that participation is voluntary, with full awareness of the nature of the activities involved.

    Journeys are conducted on well-defined, non-technical terrain selected for comfort, experience quality, and prevailing conditions. While routes are chosen conservatively and typically align with lower-complexity trail classifications, natural terrain may still present uneven surfaces, environmental hazards, or variable conditions consistent with outdoor travel.

    All journeys are operated in accordance with applicable federal, provincial, and local land management regulations, permit conditions, and park mandates. Decisions related to route selection, pacing, modifications, or discontinuation of a journey are made to ensure compliance with regulatory requirements and to support responsible, safe, and ethical guiding practices.

    2. Weather, Conditions & Route Changes
    All journeys with AWM Private Guided Tours Ltd. are designed and delivered in response to real-time mountain conditions. Weather, environmental factors, trail conditions, wildlife activity, park restrictions, and group dynamics may affect route selection, timing, pacing, and the overall structure of an experience.

    Guests acknowledge and agree that:
    specific routes, trails, viewpoints, or destinations are not guaranteed, routes may be modified or changed before or during a journey,
    timing, duration, and pacing may be adjusted, and the experience may adapt to conditions as they unfold.

    As part of our guiding approach, routes are confirmed close to the journey date in order to select the most appropriate option based on current conditions, safety considerations, seasonal character, and experience quality. This flexibility allows journeys to be conducted responsibly and reduces unnecessary pressure to adhere to fixed itineraries that may not serve guest comfort or safety on a given day.

    AWM Private Guided Tours Ltd. prioritizes experience quality, sound judgment, and responsible decision-making over adherence to predetermined routes or outcomes. Decisions related to route changes or experience modifications are made at the sole discretion of the guide and are intended to ensure a calm, well-held, and enjoyable experience for all participants.

    Guests acknowledge that outdoor journeys are not outcome-based activities and that meaningful experiences in mountain environments arise through adaptability, attentiveness, and responsiveness to conditions rather than guaranteed destinations.

    3. Participant Responsibility, Fitness & Readiness
    Guests participating in experiences with AWM Private Guided Tours Ltd. acknowledge that guided outdoor journeys require a reasonable level of physical fitness, mobility, and personal preparedness. Guests understandingly accept responsibility for assessing their own physical condition, abilities, and limitations prior to participation.

    Guests are responsible for:
    honestly disclosing any relevant medical conditions, injuries, mobility limitations, medications, or other factors that may affect their ability to safely participate, ensuring they are adequately prepared for variable mountain conditions, including appropriate clothing, footwear, food, water, and personal equipment as outlined in pre-journey communications, and following the instructions, guidance, and decisions of the guide at all times while on the journey.

    AWM Private Guided Tours Ltd. reserves the right to modify pacing, routes, or activities, or to limit or discontinue a guest’s participation, if a guest’s fitness, preparedness, conduct, or failure to follow instructions compromises their own safety, the safety of others, or the overall quality of the experience. Such decisions are made solely in the interest of safety, group well-being, and responsible guiding.

    Guests acknowledge that outdoor environments are dynamic and that conditions may change during a journey. Participation requires attentiveness, cooperation, and a willingness to adapt to conditions and guidance provided throughout the experience.

    4. Cancellation & Rescheduling

  • All bookings with AWM Private Guided Tours Ltd. are subject to a cancellation and rescheduling policy, which is provided during the booking process and confirmed prior to final reservation. By proceeding with a booking, guests acknowledge and agree to the applicable policy in effect at the time of confirmation.

    Because all journeys are planned in response to seasonal conditions, weather, group composition, and safety considerations, specific routes, timing, and experience details may be adjusted before or during the journey. Decisions related to route selection, timing, modifications, or cancellation due to weather, environmental conditions, park restrictions, wildlife activity, or safety concerns are made at the sole discretion of the guide and AWM Private Guided Tours Ltd.

    In the event that a journey must be modified, rescheduled, or cancelled for safety or operational reasons, reasonable efforts will be made to offer an alternative date, location, or experience where possible. Refunds, credits, or rescheduling options, if any, are governed by the applicable cancellation policy and are not guaranteed in all circumstances.
    Guests acknowledge that outdoor experiences involve variables beyond the control of the business and that flexibility is an essential part of safely and responsibly operating in mountain environments.

    5. Force Majeure

    AWM Private Guided Tours Ltd. shall not be liable for any delay, modification, suspension, or cancellation of services resulting from events beyond its reasonable control (“Force Majeure Events”). Such events include, but are not limited to, extreme or unpredictable weather conditions, wildfire or smoke, avalanche risk, flooding, landslides, earthquakes, public health emergencies, government orders, park or land management restrictions or closures, wildlife activity, acts of God, acts of terrorism, labor disruptions, transportation interruptions, or any other environmental, natural, or regulatory conditions that make the planned journey unsafe, impractical, or impossible to operate.

    In the event of a Force Majeure Event, AWM Private Guided Tours Ltd. reserves the right to modify routes, timing, locations, or experience design, or to reschedule or cancel the journey in the interest of safety, regulatory compliance, and responsible guiding. Reasonable efforts will be made, where feasible, to offer alternative dates, locations, or comparable experiences; however, such offers are not guaranteed and are subject to the applicable cancellation and rescheduling policy in effect at the time of booking.

    Guests acknowledge that mountain environments are inherently dynamic and that Force Majeure Events may arise with little or no notice. By participating in a journey, guests accept that flexibility is an essential component of safely and responsibly operating in wilderness settings.

    6. Intellectual Property

  • All content made available through the AWM Private Guided Tours Ltd. website and related materials is the property of AWM Private Guided Tours Ltd., unless otherwise stated. This includes, but is not limited to, website text, written materials, photographs, Journey Stories, interpretive content, and other original materials created or provided as part of our services.

  • Guests are granted a limited, personal, non-commercial license to view, download, and use such materials for their own personal reference and enjoyment. Content may not be copied, reproduced, distributed, published, modified, or used for commercial purposes without prior written consent from Adventures With Meaning Inc.

  • Journey Stories and related materials provided to guests are intended for personal use only. Guests may share their own Journey Story privately or publicly at their discretion; however, AWM Private Guided Tours Ltd. retains the underlying intellectual property rights to the content unless otherwise agreed in writing.
    This clause does not restrict reasonable personal sharing or enjoyment of materials and is intended solely to protect original creative work and interpretive content developed by AWM Private Guided Tours Ltd.

    7.) Governing Law & Jurisdiction
    AWM Private Guided Tours Ltd. is a federally incorporated company operating in the Provinces of Alberta and British Columbia. These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Alberta and the applicable laws of Canada therein, without regard to conflict of laws principles.

    8.) Journey Story Keepsake, Photography & Confidentiality
    As part of the experience design, AWM Private Guided Tours Ltd. may create a Journey Story Keepsake following a guided journey. This may include select photographs, short video moments, and a written reflection intended to serve as a personal record of the experience for the guest.

    Journey Stories are private by default.
    AWM Private Guided Tours Ltd. does not publish, share, or otherwise use guest names, identifiable images, personal reflections, or Journey Story materials for marketing, promotional, or public purposes without the guest’s explicit consent. Consent, if given, may be withdrawn at any time prior to publication.

    For Private Guided Journeys (1–2 guests), confidentiality and discretion are foundational. No guest information, imagery, route details, or experience content is shared publicly unless expressly authorized in writing by the guest.
    Guests may share their own Journey Story or personal images at their discretion. AWM Private Guided Tours Ltd. retains the underlying intellectual property rights to Journey Story materials, unless otherwise agreed in writing, while respecting guest privacy and confidentiality as outlined above..

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
