ACTIVITY WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT
THIS ACTIVITY WAIVER FORM (this “Waiver”) is made on this ___ day of __________, 20, by and between the undersigned Participant and AWM Private Guided Tours Ltd. (“Activity Provider”), operating in Alberta and British Columbia.

2. DESCRIPTION OF ACTIVITY
Scheduled from _____________ to _____________, the Participant may engage in one or more activities involving professionally guided, non-technical outdoor experiences in mountain environments, including but not limited to hiking, snowshoe travel and related walking, seasonal interpretation, and backcountry nature observation (collectively, the “Activity”).
The Activity takes place on natural terrain, which may include uneven surfaces, roots, rocks, mud, snow, ice, water edges, varying elevation and environmental changes. The Activity Provider’s guides use conservative route selection, pacing, and judgment, but conditions may change before or during the Activity, and specific trails, routes, destinations, timing, or outcomes are not guaranteed.
3. ACKNOWLEDGMENT OF RISK
The Participant acknowledges that:
a) participation in outdoor mountain environments involves inherent risks, dangers, and hazards that cannot be fully eliminated, even with professional guidance, training, precaution, and common sense;
b) these risks include, but are not limited to, slips, trips, falls, changes in weather, temperature extremes, wildlife encounters, uneven and variable terrain, trail hazards, exposure to natural elements, remoteness from medical facilities, exhaustion, dehydration, hypothermia, heat-related illness, and other risks both known and unknown;
c) such risks may result in personal injury, illness, disability, property loss/damage, or death.
The Participant voluntarily accepts and assumes all risks associated with participation in the Activity.
4. RELEASE AND WAIVER
In consideration of being permitted to participate in the Activity, the Participant, on behalf of themselves, their heirs, estate, assigns, personal representatives, and next of kin, hereby:
a) RELEASES AND FOREVER DISCHARGES AWM Private Guided Tours Ltd., its directors, officers, guides, employees, agents, independent contractors, representatives, successors, and assigns (collectively, the “Releasees”) from any and all claims, demands, actions, costs, damages, judgments, or liabilities of any nature whatsoever arising out of or related to the Participant’s participation in the Activity, including personal injury, property damage, or death, whether arising from negligence or otherwise;
b) WAIVES ANY AND ALL CLAIMS the Participant may have now or in the future against the Releasees; and
c) AGREES NOT TO SUE the Releasees for any loss, damage, injury, or death arising out of or related to participation in the Activity.
5. INDEMNITY
The Participant agrees to indemnify, defend, and hold harmless the Releasees from any and all liability for claims brought by the Participant or any third party arising from the Participant’s conduct or participation in the Activity.
6. FITNESS TO PARTICIPATE & RESPONSIBILITY
The Participant acknowledges and warrants that:
a) they are physically and mentally capable of participating in the Activity;
b) they have fully disclosed any known medical conditions, injuries, disabilities, or other factors that might affect their safe participation;
c) they will arrive prepared with appropriate clothing, footwear, food, water, and personal equipment;
d) they will follow all instructions and guidance of the Activity Provider’s guides; and
e) the Activity Provider may modify, limit, or discontinue participation if, in the Activity Provider’s sole judgment, the Participant’s condition or conduct compromises safety, group cohesion, or experience quality.
7. GOVERNING LAW
This Waiver is governed by and shall be interpreted in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein. Any dispute shall be resolved in the courts of Alberta.
8. CONFIDENTIALITY & PRIVACY
The Participant acknowledges that AWM Private Guided Tours Ltd. may produce a Journey Story Keepsake that includes select photographs, short video moments, and a written reflection for the Participant’s personal use. Such materials are private by default and will not be shared publicly without the Participant’s explicit written consent. For Private Guided Journeys (1–2 guests), confidentiality is foundational and no personal information, imagery, or details of the experience will be published without written authorization.
9. PHOTO/VIDEO RELEASE (OPTIONAL)

10. MINOR PARTICIPATION
If the Participant is under the age of majority in their jurisdiction:
By my signature below, I certify that I am the parent/legal guardian of the minor named above and that I have the authority to enter into this agreement on behalf of the minor participant. I agree, on behalf of the minor and myself, to all terms, releases, and assumptions of risk contained herein.
11. ACKNOWLEDGMENT OF UNDERSTANDING
The Participant acknowledges:
a) they have read this Waiver in full, understand its terms, and voluntarily sign it;
b) they understand this Waiver affects their legal rights, including the right to sue;
c) they are signing of their own free will.
